Winterfrost Systems Ltd. ("Winterfrost") takes the privacy of personal information very seriously. Our complete corporate privacy policy is below.

Winterfrost collects non-personal information every time you visit any of our websites. This information is used strictly for internal statistics and tracking. Non-personal information includes, but may not be limited to IP address, browser information, referral page URL, search criteria, and number of pages visited.

Winterfrost may collect personal information from you only when you engage in a software transaction, subscribe to a mailing list, participate in our forums or comments areas or through normal business correspondence by email or phone. Personal information may include your name, company name, address, email address, phone number, instant messenger contact names, website, occupation, interests, credit card number, and software serial/registration numbers for Winterfrost products.

Information is collected and used in the following ways:

General

Winterfrost will not sell, rent, or transfer your personal information to any third parties unconnected with a software transaction.

In the event that Winterfrost or certain of our assets are acquired, your personal information may be one of the transferred assets.

You acknowledge that your personal information may be stored and processed on servers located any where in the World, including either inside or outside of Canada and the USA. You consent to your information being transferred outside Canada and the USA and being stored and processed at our discretion on any of our servers wherever located.

We will permit only authorized employees, who are trained in the proper handling of personal data, to access your personal information.

To further protect your personal information, we have a security system that includes: firewall technologies, encryption, and logical and physical security restrictions to our databases and systems.

You should be aware that there is always some risk involved in transmitting information over the Internet. There is also some risk that others could penetrate or otherwise disable our security systems. Because of this, while we strive to protect your information, Winterfrost cannot ensure or warrant the security and privacy of any personal information, and you provide it to us at your own risk.

Winterfrost may use third-party service providers to act on our behalf, for example credit card processing, and market research analysis. These third parties may have access to your information in the course of providing these services on behalf of Winterfrost. Any personal information we provide to such third parties is protected under confidentiality agreements.

Use of your personal information by third party contractors when working on behalf of Winterfrost shall be subject to our Privacy Policy. Use of your personal information by other third parties who receive your information will be in accordance with their privacy policies.

You may request that any collected personal information be changed, updated or removed from Winterfrost's records, which will be completed upon verification of the validity of the request. If a request is made to delete information that is linked to a software serial or registration number, the serial or registration number will be cancelled, effectively revoking the license. You should be aware that it is not possible to remove or verify each and every record of the information you have provided to us and that any changes or deletions will not effect the information we have provided to third parties in accordance with this policy prior to such change or deletion. The need to back-up our systems to protect information from inadvertent loss means that a copy of your information may exist in a non-erasable form that will be difficult or impossible for us to locate.

Except as stated above, this Privacy Policy does not apply to the practices or policies of any third parties, such as companies or entities that we do not own or control, and does not apply to any links to sites that are not maintained by us, or to people that we do not employ or manage.

Non-Personal Information

Winterfrost automatically collects non-personal information regarding our visitors, such as software client information (for example, IP addresses, browser versions and operating systems) and aggregate information (for example, number of pages accessed) in order to analyze Web traffic and usage trends. Information of this nature does not pertain to your specific identity and is not associated with your personal information.

Winterfrost and our advertisers employ common Internet technologies, such as "cookies," to collect and store non-personal information about our visitors. Cookies and other technologies may be used by Winterfrost or advertisers to determine how you reached us, track usage patterns once you are on our sites, provide geographic reference based on IP address, and present targeted advertising.

Non-personal information may be made available to third parties as part of aggregate and/or demographic data.

Software Transactions

When completing a software purchase, you will be asked to submit information required to complete the transaction. This may include any of the personal information types listed above. Any commercial products licensed from Winterfrost will be assigned a unique serial or registration number which will be linked to the personal information provided at the time of purchase. This number will be used to protect the copyright of the software and prevent piracy.

To improve the security of your personal information during any software transaction, information will be encrypted with industry-standard, secure-socket-layer (SSL) technology before it is transferred across the Internet from your personal computer to our secure servers.

To complete a software purchase, your personal information will be shared with any third parties required to complete the transaction (e.g. credit card or other payment authorization/facilitation companies). Winterfrost will not store any credit card information, though this information may be stored by a third-party.

Mailing List Subscriptions

You may request joining a mailing list for product notifications, updates, and other offers. In this case, your name, company name, and email address will be requested.

Winterfrost will send you email on topics including notifications of important product information, security announcements, new product releases, website updates, and other special offers sponsored by Winterfrost. Winterfrost will not send you notifications for any third-party products or offers. You may unsubscribe Winterfrost's mailing list at anytime by following the unsubscribe instructions that appear in each email.

Forum Participation

When participating in the Winterfrost Community forums or submitting other comments (e.g. on the TechBytes website), you may be requested to supply any number of the personal information items above. The Winterfrost forums require a valid email address for registration purposes to prevent abuse of the forums. All other information is optional and should be provided voluntarily.

Business Correspondence

Any of the above personal information may be requested or acquired through the course of regular business correspondence (e.g. email or telephone). This information will not be used for any purpose other than completing the purpose of the correspondence without your explicit permission.

Legal Usage

We may disclose your personal information to authorities if you violate our Terms of Use or any law, rule, or regulation, or if required by law or regulatory authority (for example, court order or subpoena).

Privacy Policy Updates

This privacy policy has been in effect since December 27, 2005. We may, at our discretion, revise this Privacy Policy at any time. All such revisions shall be effective when posted on the www.winterfrost.com website and will be accompanied by an announcement on our homepage. Mailing List subscribers may also be notified of such changes.
